Subscription Access and Management

Sixyce offers unlimited product design services through a subscription-based model.

The specific details of subscription plans and pricing are subject to change and are not included in these terms and conditions.

Access to our design services requires an active subscription, which can be managed through the Stripe billing portal. This includes options to pause or cancel the subscription.

Payment Terms

Full payment for the chosen subscription plan must be received before any design work commences.

Payments are due in accordance with the billing cycle established through the Stripe billing portal.

Subscription Cancellation and Pause

Subscriptions can be cancelled at any time without incurring cancellation fees, directly through the Stripe billing portal.

Upon cancellation, clients retain ownership of all completed design work delivered during the active subscription period.

Clients may pause their subscription for a period of time and use the remaining paid subscription as credits for future services. This pause must be requested at least one week in advance by directly contacting a Sixyce representative.

The resumption of services after a pause is subject to availability and scheduling capacities of Sixyce. While we strive to accommodate clients' timelines, we cannot guarantee immediate resumption of services. Clients will be informed of the earliest possible date when services can resume.

Design Work and Delivery

Design tasks are addressed sequentially. Estimated delivery times are 24-48 hours for smaller tasks and 1-2 weeks for larger, more complex tasks. These are estimates and may vary based on the specifics of each task.

Specific delivery timelines for each task will be communicated to the client through the dedicated customer portal. These timelines are subject to change based on the evolving nature of the design work and client feedback.

The speed of task completion is also dependent on timely client responses and approvals. Delays in feedback or changes in project scope by the client may result in adjustments to delivery timelines.

In cases of high demand or unforeseen circumstances (e.g. illness, technical issues, natural disasters), Sixyce reserves the right to extend delivery timelines as necessary. Clients will be promptly informed of any such delays and provided with updated timelines.

Sixyce commits to maintaining open and transparent communication with clients regarding any changes or updates to project timelines.

Intellectual Property Rights

Upon full payment, clients gain ownership of the intellectual property rights to the final, approved designs. This transfer of rights pertains to the use, reproduction, and display of the final designs as per the client's business needs.

Preliminary or draft designs, as well as any creative concepts or ideas generated during the design process, remain the intellectual property of Sixyce.

Following the public release of a completed project, Sixyce retains the right to claim creatorship and may display the work in its business portfolio. This includes the right for individual designers at Sixyce to showcase the work in their personal portfolios.

This right to display the work is for promotional purposes and does not imply any ownership over the final design once intellectual property rights have been transferred to the client.

Service Modifications and Outsourcing

Sixyce reserves the right to modify, suspend, or discontinue any aspect of the services. Clients will be informed of any significant changes that could affect their service.

In case of any major modification or suspension of services, clients have the option to:

- Accept the changes and continue with the modified service, terms and pricing (if applicable).

- Pause their subscription until services resume.

- Cancel their subscription with a pro-rated refund for the unused portion, if the changes significantly disrupt service delivery.

If a service is discontinued, clients will receive a pro-rated refund for any prepaid but undelivered services.

In order to manage workload and maintain service quality, Sixyce may outsource design tasks to qualified external designers. These designers are carefully selected and are required to adhere to the same standards of quality, professionalism, and confidentiality as in-house staff.

Outsourcing decisions are made with careful consideration of the specific needs of each project, ensuring that the most suitable talent is assigned to each task. Sixyce remains responsible for the management and quality of the work delivered by external designers.

All outsourced work is subject to the same review and quality assurance processes as work done by in-house staff to ensure consistency and client satisfaction.

Sixyce is committed to maintaining the confidentiality and security of client information, regardless of whether a project is handled in-house or outsourced. All external designers are bound by confidentiality agreements to protect client data and proprietary information.

Client Responsibilities

Clients are responsible for providing all necessary information, materials, and feedback in a timely and accurate manner for the design process. This includes, but is not limited to, design specifications, brand guidelines, and any specific content required for the project.

Delays in providing this information, or providing incomplete or inaccurate information, may result in delays in the design process. Sixyce is not responsible for any project delays caused by late or inadequate provision of required information by the client.

Clients are expected to adhere to the payment terms agreed upon at the commencement of the subscription. Payments are due as per the schedule established through the Stripe billing portal.

Failure to meet payment deadlines may result in a temporary suspension of services until payment is received. Sixyce reserves the right to withhold delivery of design work for overdue accounts and even cancel the subscription.

It is the client’s responsibility to manage their subscription through the Stripe billing portal, including pausing or canceling the subscription. Any major changes in the subscription status should be communicated to Sixyce as soon as possible to ensure proper account management.

Pricing and Price Changes

Subscription fees are subject to change. Clients will be notified of any price changes at least 15 days before the end of their current subscription term. Price changes will apply upon subscription renewal.

Confidentiality

Sixyce is committed to maintaining the confidentiality of all client information and design concepts. This includes, but is not limited to, personal data, business information, project details, and any communications between Sixyce and the client.

Confidential information will not be disclosed to third parties except as required for the completion of design services and management (Outsourced designers under confidentiality agreements, project management platform and billing platform) or as required by law.

This confidentiality obligation survives the termination of any service or subscription agreement and remains in effect indefinitely.

Governing Law and Jurisdiction

These terms and conditions, and any disputes arising from or in connection with them, are governed by and construed in accordance with the laws of Romania.

Clients agree that any legal action or proceedings arising out of or in connection with these terms and conditions shall be brought exclusively in the courts of Romania.

This section does not prevent Sixyce from seeking injunctive relief (or any equivalent type of urgent legal remedy) in any jurisdiction.
